Terms of Use

The basic ground rules for using this website and MapleKingdom apps.

These Terms of Use ("Terms") govern your use of the MapleKingdom website at maplekingdom.com ("the Site") and any MapleKingdom-published iOS application ("the Apps"), unless an App provides its own end-user license agreement (EULA) that says otherwise.

"MapleKingdom," "we," "us," and "our" refer to MapleKingdom, the iOS studio that publishes the Apps and operates the Site. "You" means the person using the Site or an App.

1. Acceptance

By using the Site or an App, you agree to these Terms. If you don't agree, don't use them. That's it.

2. App store EULA

iOS Apps published by MapleKingdom are licensed to you, not sold. Unless an individual App displays its own custom license, the Apple Standard End User License Agreement applies. You agree to that EULA in addition to these Terms.

3. Your account

Some Apps require an account. You're responsible for keeping your sign-in credentials secure and for activity that happens under your account. Let us know as soon as possible if you think your account has been accessed by someone else.

You can delete your account at any time. See the account deletion page for instructions.

4. Acceptable use

Don't do the obvious bad stuff:

  • Don't try to break, reverse-engineer, or interfere with the Site or any App
  • Don't use the Apps to harass anyone or upload illegal content
  • Don't attempt to access other users' accounts or data
  • Don't scrape the Site or Apps in a way that disrupts service for others
  • Don't use the Apps in ways that violate Apple's App Store guidelines

5. Your content

If an App lets you create content (custom flashcards, photos, notes, etc.), you keep ownership of that content. You grant MapleKingdom a limited license to store and display it as needed to make the App work for you.

You're responsible for what you upload. Don't upload anything you don't have the right to use.

6. Purchases and subscriptions

If an App offers in-app purchases or subscriptions, those transactions are handled by Apple through the App Store. Pricing, billing, and refunds are governed by Apple's terms. Refund requests should go through reportaproblem.apple.com.

7. Beta programs

Some Apps go through public beta testing before launch. Beta builds may be incomplete, slow, or buggy. Feedback you provide during a beta is appreciated and may be used to improve the App; you don't expect compensation for it.

8. Intellectual property

The Site and Apps, their design, code, and original content are owned by MapleKingdom (or licensed to it). You're granted a personal, non-exclusive, non-transferable right to use them. Apple is a third-party beneficiary of the license to use the Apps and may enforce these Terms with respect to App use.

9. Third-party services

The Apps and Site rely on third-party services (Firebase, OpenAI, Apple, etc.) listed in the Privacy Policy. Their terms apply when you interact with them. We're not responsible for their availability, just for using them carefully.

10. Disclaimers

The Site and Apps are provided "as is." We do our best to make them work well, but can't guarantee they'll be uninterrupted, error-free, or perfectly suited to your needs. Specifically, MapleKingdom apps that teach languages or any other skill are aids, not guarantees of fluency or proficiency.

11. Limitation of liability

To the extent allowed by law, MapleKingdom isn't liable for indirect, incidental, or consequential damages from your use of the Site or Apps. Total liability for any claim is capped at the amount you paid for the App in the 12 months before the claim, or USD $50 if you didn't pay anything.

12. Termination

You can stop using the Site and Apps at any time. We may suspend or terminate access if you violate these Terms or use the service in a way that harms other users.

13. Changes to these Terms

If we change these Terms, we'll update the "last updated" date at the top. For significant changes, we'll give notice in the app or by email when reasonable. Continued use after changes means you accept the new Terms.

14. Governing law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Washington.
